• Any scorecards, quizzes, landing pages, or booking pages we operate through platforms such as ScoreApp and GoHighLevel

If you engage our paid services, those services are governed by a separate written agreement between us and your organization. These Terms govern your use of our public websites and free resources.

1. Acceptance of Terms

By accessing or using our websites or services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our websites or services.

2. Use of Our Services

You may use our websites and services only for lawful purposes. You agree not to:

• Misuse or interfere with our technology, systems, or data
• Submit false or misleading information
• Use our services to send spam or unsolicited messages
• Violate the intellectual property rights of MediatorSPARK or any third party

3. Intellectual Property

All content on our websites, including designs, text, graphics, logos, videos, and software, is the property of MediatorSPARK, Inc. or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or modify any content without our written permission.

4. Scorecards, Quizzes, and Educational Content

Our quizzes, scorecards, and educational content are provided for informational purposes only. Results and interpretations are not guarantees of outcomes and are not professional advice, including legal, psychological, or financial advice. MediatorSPARK provides training and coaching. We do not provide mediation, counseling, psychological, crisis-intervention, or other professional services, and our content and results should not be relied upon as a substitute for them.

5. AI-Assisted Services

We use artificial intelligence tools to help operate our services, including for notes, transcription, drafting, and research. AI-assisted output is reviewed by our team and is provided for general informational purposes only. It is not professional advice and is not guaranteed to be accurate or error-free. 6. Call Recording

We record and transcribe many of our calls and video meetings, as described in our Privacy Policy. We provide notice at the start of a call when it is being recorded, and you may decline and continue the call without recording. If you continue with the call after we provide that notice, you consent to being recorded.

7. Email and Text Communication

If you provide your email address, you may receive emails you have requested or opted into, such as your quiz results, replies to your inquiry, updates, and educational content. If you provide your phone number, we may use it to respond to you, and we will send text messages only where you have opted in to receive them. Message and data rates may apply, and you can opt out of texts at any time by replying STOP. You can opt out of marketing emails at any time using the "unsubscribe" link in any email or by contacting support@mediatorspark.com. Consent to receive marketing messages is not a condition of using our services.

8. Disclaimer of Warranties

Our websites and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the services will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, MediatorSPARK, Inc. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, our websites or free resources. Our total liability for any claim arising from your use of our public websites and free resources shall not exceed $100 USD. Liability relating to paid services is governed by the separate written agreement for those services.

10. Indemnification

You agree to indemnify, defend, and hold harmless MediatorSPARK, Inc., its officers, employees, and affiliates from any claims, liabilities, or expenses arising out of your use of the services or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in the state or federal courts located in New York County, New York.

12. Modifications

We may update these Terms at any time. Changes will be posted on this page with a revised effective date.
